WinningMind AI is a mental performance coaching service built on sport performance research. We provide AI-driven coaching for athletic performance — competitive focus, competitive resilience, athletic confidence, game-day pressure management, and athletic performance skills.
WinningMind is not a mental health service. We do not provide therapy, psychological treatment, diagnosis, or management of mental health conditions. If you are experiencing a mental health crisis, please contact the 988 Suicide & Crisis Lifeline (call or text 988), Crisis Text Line (text HOME to 741741), or your local emergency services.
These Terms of Service (“Terms”) govern your use of WinningMind AI, operated by Winning Mind LLC (“WinningMind,” “we,” “us,” or “our”). By creating an account or using our service, you agree to these Terms. If you don’t agree, don’t use the service.
You must be at least 13 years old to use WinningMind. If you are between 13 and 16 and reside in the European Economic Area or the United Kingdom, you must wait until you are 16 to use the Services, in keeping with applicable digital consent laws.
Capacity. By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding agreement.
Disaffirmance. If a minor user exercises the right to disaffirm this agreement under applicable California law (see California Family Code §§6700–6716, governing the capacity of minors to contract and the disaffirmance of minors’ contracts), we will promptly close the account and delete the associated data in accordance with our Privacy Policy.
Accuracy. You agree to provide accurate, current information when creating your account and to keep it updated.
Security. You are responsible for keeping your login credentials confidential. Tell us immediately at info@winningmind.com if you believe your account has been compromised.
One account per person. You may not create multiple accounts or transfer your account to someone else without our written permission.
What we do. WinningMind provides AI-powered performance coaching grounded in sport performance research. Our service helps athletes and performers develop athletic performance skills: competitive focus, pre-performance routines, competitive resilience, athletic confidence, performance identity and team role clarity, and game-day pressure management.
When you share medical documents. If you upload a medical document — a concussion clearance form, a physical therapy plan, a clinical assessment, a mental health intake record — your AI coach will defer to the clinical professional who created it. The coach’s role is not to evaluate, second-guess, or extend clinical findings. What the coach can work with is the psychological experience of being an athlete in that situation: the fear of re-injury, the frustration of a slow recovery, the identity pressure of being sidelined, or the experience of managing any mental health challenge that your clinical team is already treating. The medical side belongs to your doctor. The mental performance side is where we work.
When a document shows you are not yet cleared. If a medical document indicates you are still on a restriction — not yet cleared to return, still under treatment limits, or actively in a treatment protocol — we will not coach around that restriction. Mentally working around an active medical hold is out of scope for performance coaching, and the appropriate path is back to your clinical team.
What we don’t do.
When coaching isn’t enough. Our AI coaches are trained to recognize when a situation goes beyond the scope of performance coaching — sustained mood changes, disordered eating, trauma responses, safety threats involving minors or disclosures of abuse or neglect. In those situations, the coach will acknowledge what it’s hearing, pause the performance conversation, and point you toward appropriate professional resources. This is a feature, not a limitation. Getting the right help is always the right move.

WinningMind offers subscription plans billed on a monthly or annual basis. Monthly subscription is $30/month, with a discount for annual subscriptions. Current pricing for each sport is shown on the sport’s coach page (winningmind.ai/baseball, winningmind.ai/soccer, winningmind.ai/golf) and at the time of checkout.
Your subscription renews automatically. At the end of each billing period, your subscription will renew at the then-current price unless you cancel before the renewal date. Your payment method will be charged automatically.

You must affirmatively check a box confirming you understand these terms before completing your purchase. Pre-checked boxes are not used.
Annual subscribers: We will send you a reminder at least 30 days before your annual renewal date, to the email address on your account.
We may change subscription prices. We’ll give you at least 30 days’ notice by email before a price change affects your account. For California subscribers, we will obtain your affirmative consent before applying a price increase to your account, as required by California Business and Professions Code §17602(c). If you don’t cancel before the change takes effect, you agree to the new price.
You can cancel anytime, in the app. Go to Account → Subscription → Cancel Subscription. No phone call required. No explanation required. No forms.
Your cancellation is recorded immediately. Processing with our payment provider is completed within 1 business day. You will not be charged again after cancellation. You retain full access to the service through the end of the period you have already paid for. We do not issue prorated refunds for unused time within a billing period, except as required by law or as provided in Section 5.5.
Note on data retention after cancellation: Conversation history is deleted within 90 days of cancellation (see Section 5.4 below). Account metadata (email, profile information) is retained for up to 12 months for fraud prevention and legal compliance purposes, as detailed in our Privacy Policy.
After cancellation, your account data is retained for 90 days and then deleted, unless you request deletion sooner through your account settings. At cancellation, you’ll have the option to download your full conversation history before deletion.
We offer a 14-day satisfaction guarantee for new subscribers. If you cancel within 14 days of your first paid subscription, contact us at info@winningmind.com for a full refund. After that window, no refunds are issued for the current billing period.
If we make a billing error, contact us and we’ll fix it promptly.
If we offer a free trial, we’ll tell you the trial length and what you’ll be charged when it ends before you start. You can cancel anytime during the trial without charge.
You agree to use WinningMind for lawful purposes and in accordance with these Terms.
You will not:
Content you submit. You are responsible for the content of your messages and interactions. Don’t use the coaching interface to share content that is illegal, abusive, or designed to manipulate the AI in ways that violate these Terms.
WinningMind lets you upload files to share with your AI coach. This section covers what’s allowed, what the limits are, and what we ask you not to upload.
What you can upload. The following file types are supported in the current version:
Video, audio files, executable programs, compressed archives, and other file types are not supported in the current version.

What you may not upload.
A note on uploading documents about other athletes. If you upload a scout report, assessment, or document that contains another athlete’s personal information, we may decline to process it. WinningMind is built around your coaching experience, not data collection about other people.
WinningMind AI, including its software, AI systems, prompts, coaching methodology, brand, and all content we create, is owned by Winning Mind LLC or licensed to us. These Terms do not transfer any ownership rights to you. You receive a limited, personal, non-transferable, non-sublicensable license to use the service as provided in these Terms.
You own the content you submit through the service — your messages, goals, and coaching conversations. By submitting content, you grant us a limited license to use it to provide the service to you, improve our safety and moderation systems (for example, by reviewing flagged content to reduce false positives in crisis detection), and fulfill our legal obligations. We do not use your personal coaching conversations to train AI models without your explicit consent.
If you give us feedback or suggestions, we may use them without obligation to you.
You own what you upload. Files you upload to WinningMind remain yours. Uploading a file doesn’t transfer ownership to us.
The license you give us. By uploading a file, you give Winning Mind LLC a limited, non-exclusive, royalty-free license to:
That’s the full scope. We do not use the content of your uploaded files to train AI foundation models, build datasets, sell data, or any other purpose beyond delivering your coaching session and keeping the service safe.
We do not train on your files. Just as we do not use your coaching conversations to train AI models without your explicit consent (§7.2), we do not use the content of your uploaded files to train AI models. Anthropic, our AI processing provider, is bound by the same no-training terms under our Data Processing Agreement.
Deletion. When you delete a message, the files attached to that message are deleted at the same time. When you close your account, your uploaded files are deleted within 90 days, consistent with our conversation retention policy. You can request earlier deletion through Account Settings or by contacting info@winningmind.com.
What you represent about uploaded files. By uploading a file, you represent that:
WinningMind’s coaching is generated by artificial intelligence. Our coaches are not human. AI can be wrong, incomplete, or mismatched to your specific situation. Coaching responses should not be treated as professional psychological advice, medical advice, or a substitute for working with a qualified human professional. This applies equally to the AI’s analysis of uploaded files — a coaching response about your training plan, scout report, or medical document should be treated as coaching, not professional advice.
We are transparent about the AI systems powering WinningMind: language model capabilities are provided by Anthropic (Claude). Voice transcription is provided by OpenAI (Whisper). Voice output is provided by ElevenLabs. See our Privacy Policy for details on how these subprocessors handle your data.
The service is provided “as is” and “as available.” To the fullest extent permitted by law, WinningMind disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the service will be uninterrupted, error-free, or that AI-generated coaching will be accurate, complete, or appropriate for your specific situation. We do not warrant that using our service will improve your athletic performance or mental skills.
The service is not a licensed mental health treatment and does not carry the warranties or professional obligations that licensed clinical services carry.
To the fullest extent permitted by applicable law, WinningMind and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the service.
Our total liability to you for any claims arising from these Terms or your use of the service will not exceed the greater of (a) the amount you paid to WinningMind in the 12 months before the claim arose, or (b) $100.
Some jurisdictions do not allow exclusion of certain warranties or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
California carve-out. Nothing in these Terms limits any liability that cannot be excluded under California law, including under California Civil Code §1668.
You agree to defend, indemnify, and hold harmless Winning Mind LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the service.
Governing law. These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Informal resolution. Before filing any formal claim, contact us at info@winningmind.com and give us 30 days to resolve the issue.
Jurisdiction. Any disputes not resolved informally will be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there.
We may update these Terms. When we do, we’ll post the updated Terms at winningmind.ai/terms and update the “Last updated” date at the top. For material changes, we’ll notify you by email or in-app notice at least 30 days before the change takes effect. Your continued use of the service after the effective date means you accept the updated Terms.
We may suspend or terminate your account if you violate these Terms, if we reasonably believe your use poses a legal or safety risk, or if we discontinue the service entirely. We will provide at least 30 days’ notice for termination not related to Terms violations, and will provide a pro-rata refund of any prepaid subscription fees for the unused period. You may stop using the service and delete your account at any time through Account Settings.
On termination, your right to use the service ends. Sections that should survive termination (IP, limitation of liability, indemnification, dispute resolution) do survive.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
